Overview
Contracts and tenders determine how much of the value in an energy project is kept or lost. A poorly prepared tender attracts unrealistic bids, unclear scope leads to claims and variations, and weak contract administration lets disputes grow until they threaten the schedule and the relationship with the contractor. Operators and contractors in the oil and gas sector both need staff who understand the full cycle. This course covers contracts and tender management from planning the contract strategy to closing out. Participants learn contracting strategies and contract types, including lump sum, reimbursable and EPC, and the structure of common forms such as FIDIC. They study preparing tender documents, prequalification, technical and commercial bid evaluation, negotiation and award. The course then covers contract administration, managing variations and claims, performance and payment, risk and liability clauses, dispute avoidance and resolution, and contract close-out, using energy sector cases throughout.
Objectives
- Select a contracting strategy and contract type for a project
- Prepare clear tender documents and scopes of work
- Run prequalification and bid evaluation processes
- Negotiate and award contracts
- Administer contracts, payments and performance
- Manage variations, claims and disputes
- Understand key risk, liability and indemnity clauses
Who should attend
Contracts and procurement staff, project managers and engineers, contract holders, legal and commercial staff in operating and contracting companies.
Training methodology
Participants work through a tender for a sample construction and maintenance contract. They choose a contract strategy, draft parts of the scope of work, build an evaluation matrix and evaluate three sample bids. A negotiation role-play follows. In the second half, teams handle variation requests and a contractor claim, apply the contract clauses and prepare a response. Real contract dispute cases are discussed to draw practical lessons. A short written assessment closes the course.
